DNA testing helped exonerate Gerardo Cabanillas, accused in the 1995 attack on a couple sitting in a parked car in South Gate City, the county district attorney's office said in a statement. The Conviction Integrity Unit associated with the District Attorney had re-examined the case of accused Cabanillas. After this, last week the judge overturned the conviction of Gerardo Cabanillas and found him innocent, and ordered his permanent release.
"I apologize to Gerardo Cabanillas for the miscarriage of justice and the failure of our criminal legal system," attorney Judge George Gascón said in a statement. Actually, Gerardo Cabanillas was convicted by the court in the year 1996 and after that, he was jailed. Despite being innocent, Cabanillas spent 28 years in prison. Cabanillas was accused of first hitting a couple sitting in a parked car in South Gate City, pulling the man out of the car, taking the woman to a house, and raping her.
Two days later, a couple traveling in a car was robbed in the same area, officials said. The couple, victims of the attacks, identified him as Gerardo Cabanillas by identifying him in the photo. But later during the court investigation, the victims said that they were pressurized to stamp the photo of Cabanillas.
At the same time, the DNA test conducted on the rape kit revealed that Gerardo Cabanillas was not involved in it. The Innocence Project said no other suspects were ever arrested in the case, although one man later confessed to a crime.
