Hearing on Gyanvapi case will be held on November 20, special leave petition will be considered first

Gyanvapi Case: The mosque side has challenged the case of the temple side claiming the existence of Maa Shringaar Gauri and other deities in the Gyanvapi premises and demanding the right to worship them on the basis of the Place of Worship Act. The mosque side says that the Places of Worship Act says that any religious place will have the same character as it had on August 15, 1947.

Due to paucity of time, the Gyanvapi case could not be heard in the Supreme Court on Monday. Now the court will hear this matter on November 20. In the hearing to be held on November 20, the Supreme Court will first consider the special leave petition of the Anjuman Intejamia Masjid Committee, in which the maintainability of the original lawsuit of the temple side has been questioned.

The mosque side has challenged the case of the temple side claiming the existence of Maa Shringaar Gauri and other deities in the Gyanvapi premises and demanding the right to worship them on the basis of the Place of Worship Act. The mosque side says that the Places of Worship Act says that any religious place will have the same character as it had on August 15, 1947. The character of a religious place cannot be changed.

In such a situation, the case seeking the right to worship and worship of deities on the premises is not maintainable because this law prohibits it. The case is being heard by a bench headed by Chief Justice DY Chandrachud. At the last hearing, the bench had said in its oral remarks that what was the religious character of the premises on August 15, 1947, is a matter of evidence. This will be decided by the evidence during the trial.

However, this was merely a verbal comment. The court will now hold a detailed hearing on the matter. Apart from this, two more petitions from the mosque side are pending in the Supreme Court, in which a demand has been made to appoint an Advocate Commissioner for the survey of the premises and to ban the scientific examination of the Shivalinga-like figure found in the premises during the survey. Whereas, an application has also been filed by the temple side, in which a demand has been made to conduct a survey by ASI of the Shivalinga found during the survey and the sealed area there.
