Delhi High Court has issued a guideline for those who convert to inter-religious marriage. It has been said in this guideline that some important documents will also have to be given for consent to change religion. Also, the person will have to file an affidavit. This affidavit should clearly state that he is fully aware of the consequences of the decision to change religion for marriage. The court said that the consent of the person adopting another religion is also necessary. Along with this, the person should be aware of this decision's impact on his life.
The High Court said, 'The certificate of conversion of the person converting should also be in his local language. With this, the person can read and understand the decision taken by him properly. There will be no problem in understanding it in the local language.' The court also said that the concerned authorities should get an affidavit regarding the age and marital history of both parties at the time of inter-religious marriage after conversion. However, this provision will be exempted in marriages taking place under the Special Marriage Act. Along with this, it is also necessary to file an affidavit stating that the conversion is taking place on the person's own will.
Marriage certificates and conversions should be in local languages. It is mandatory to use the language of the person converting. The court decided that the certificate of marriage and conversion should also be in the local language.
Delhi High Court also made it clear that this guideline will not apply to a person who returns to his original religion. This will happen because the person converting is already aware of his original religion.
