The policy of like-dislike in the appointment of judges is not right

While hearing the case on Monday, the bench of Justices Sanjay Kishan Kaul and Sudhanshu Dhulia said - The government is also appointing and transferring judges as per its likes and dislikes. We have warned the government about this earlier also.

The bench said- The government is still hanging the file recommending transfer of judges in Allahabad, Delhi, Punjab and Gujarat High Courts. Transfers of four judges are pending in Gujarat High Court. The government has not done anything on these till now.

Supreme Court said- Not making appointment on the names sent again is disturbing. Giving more time to implement the recommendations of the collegium, the court said that the Center should come up with a solution. The next hearing will be held on December 5. Live from Court Room: Attorney General said- Delay due to busyness of elections

Attorney General R Venkataramani: There has been a delay due to busyness in assembly elections. The government had no such intention. We have informed the government.

Supreme Court: We have recommended the appointment of 14 judges in the High Courts, but the appointment took place only in the Gauhati High Court. This likes and dislikes of the government affect the seniority order of the judges. Lawyers give their consent to become judges only for the sake of seniority. When this will not be implemented, why would he agree to become a judge?

Of the names we repeated last time, 8 are still pending. We know why those names have been hung. We also know the concern of the government. The government did not clear more than half the names. As per our information, you have issued transfer orders for 5 people but not for 6 others, 4 of them are from Gujarat. This is not a good sign.

Attorney General R Venkataramani: Court should give some more time to the government.

Supreme Court: Center should come up with a solution to this. The next hearing will be held on December 5.
