The Congress leader was arrested in an old case registered under the Narcotic Drugs and Psychotropic Substances (NDPS Act, 1985) Act in Jalalabad, Fazilka. An FIR was registered in this case against nine people including Gurdev Singh, who was later convicted under the Narcotic Drugs and Psychotropic Substances (NDPS) Act.
Information about the arrest of Punjab Congress MLA Sukhpal Khaira was given by Sukhpal himself. The Congress leader said that the raid had been conducted in an old NDPS case going against him. In Khaira's Facebook Live video, he can be seen arguing with police personnel.

In February 2023, the Supreme Court rejected the summons order against Khaira in the 2015 drug case.
