Supreme Court: The apex court refused to interfere with the decisions of the lower court and the Delhi High Court and canceled the interim order granting bail to the convict. The bench has directed the appellant to surrender before the trial court within four weeks from today.

The Supreme Court, on Wednesday, confirmed the conviction and life imprisonment sentence of a constable. He was found guilty of killing his wife's lover in the police station. While hearing the petition of the policeman, a bench of Justice Sudhanshu Dhulia and Justice Rajesh Bindal rejected the argument of convict Surendra Singh that the deceased had come to kill him, and he fired in self-defense, killing the victim. This was nothing but murder. The nature of the weapon used, the number of bullets fired at the deceased, and the part of the body in which the bullets were fired all point to the fact that the appellant has made a strategy to kill the deceased.

Refusing interference with the findings of the trial court and Delhi High Court, SC set aside the interim order that had granted bail to the convict. The Bench said, "This appeal is dismissed. The interim order dated April 2, 2012, granting bail to the appellant stands set aside, and the appellant is directed to surrender before the trial court within four weeks from today. A copy of this judgment shall be sent to the trial court to ensure that the appellant surrenders and undergoes the remaining portion of his sentence."

It has been the casein: Prosecution has alleged that the victim had an illegitimate relationship with the wife of the convict and the victim was shot dead in the Mayur Vihar police station on June 30, 2002, that the victim and the convict were last seen talking to each other inside the police station. In addition to this are witnesses—other police officers belonging to that police station—who state that the convict killed the victim with his official 9-mm carbine.
