Supreme Court: DMRC gets big relief from the court, DAMEPL will not have to pay Rs 8000 crore

Supreme Court: A bench headed by Chief Justice DY Chandrachud has approved the curative petition of Delhi Metro Rail Corporation (DMRC). In the petition, DMRC has appealed to the Supreme Court to reconsider its earlier decision.

Supreme Court has given big relief to DMRC. In fact, the Supreme Court on Wednesday accepted that DMRC is not bound to pay Rs 8000 crore to Delhi Airport Metro Express Private Limited Company and accepted the curative petition of DMRC. Delhi Airport Metro Express Private Limited is a company of Anil Ambani-led Reliance Infrastructure firm. A bench of Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra heard the case.

The Supreme Court has approved the curative petition of DMRC against its 2021 decision. The bench said that the earlier decision of the Supreme Court in this case was not just. In the year 2017, the tribunal had ordered the payment of Rs 7200 crore to DMRC, which after adding the interest amount, this amount was a total of Rs 8 thousand crore. DAMEPL has expressed disappointment over the decision.

DMRC filed a petition to challenge the order directing DAMEPL to be paid Rs. 8,000 crore. Anil Ambani's company, Delhi Airport Metro Express Limited, operated the Airport Express Line of Delhi Metro. However, in 2013, DMRC terminated the company's contract ahead of schedule for a number of reasons. DMRC had additionally failed to pay the company's termination fee. A legal dispute ensued between Delhi Airport Metro Express Limited and DMRC as a result of the latter's opposition to the latter's decision. The case was sent to arbitration in 2017, and the panel decided in Ambani's business DAMEPL's favour, directing DMRC to reimburse the company for the arbitration award. This sum has now increased to approximately eight thousand crores, interest included.
