The Congress has petitioned the Delhi High Court to postpone the Income Tax Department's notice demanding the collection of over Rs 105 crore in overdue taxes. The stay request against the Income Tax Department's attempt to recover and freeze his bank accounts was denied earlier on Friday by the Income Tax Appellate Tribunal (ITAT).

In front of a bench led by the Acting Chief Justice, senior attorney Vivek Tankha brought up the issue. The case can now be heard by the court today. In front of a bench consisting of Justice Tushar Rao Gedela and Acting Chief Justice Manmohan, senior attorney Vivek Tankha presented the petition.

Tankha said the matter required an urgent hearing as transactions from Congress accounts had been frozen. Acting Chief Justice Manmohan said that if the petition is in order then it should be listed for hearing today.

Last week, the Income Tax Appellate Tribunal rejected the Congress party's appeal against the imposition of penalty for discrepancies in 'tax returns' of previous years. The party had earlier said the tribunal's order freezing Congress' funds was an "attack on democracy" as it came just ahead of the Lok Sabha elections.

Earlier, the Tribunal (ITAT) here had rejected the Congress's appeal against the imposition of a fine of Rs 210 crore by the Income Tax Department.
